Hatteras Island DWI and Traffic Ticket Lawyer
Charged With DWI or Ticketed on Hatteras Island?
A DWI charge or traffic ticket from Rodanthe, Waves, Salvo, Avon, Buxton, Frisco, or Hatteras village goes to one of two courts. A charge written by the Dare County Sheriff’s Office or the NC State Highway Patrol is heard in Dare County court at the Dare County Justice Center, 962 Marshall Collins Drive in Manteo. A citation written by a National Park Service ranger in Cape Hatteras National Seashore goes to federal court.
Hatteras Island has no town police departments. Its seven villages are unincorporated, so the Sheriff’s Office, which has an office in Buxton, and the Highway Patrol handle state charges. NC 12 is the only highway down the island, from the Marc Basnight Bridge over Oregon Inlet to the ferry docks in Hatteras village, and between the villages it runs through the National Seashore and Pea Island National Wildlife Refuge.

State Charge or Federal Citation?
Look at the paperwork you were handed. The same stretch of NC 12 can produce either one, depending on who made the stop.
- North Carolina Uniform Citation: written by a deputy or a trooper. It lists Dare County and a court date in Manteo.
- United States District Court Violation Notice: written by a National Park Service ranger or another federal officer. It is a federal case. See federal charges in the Outer Banks.

DWI on Hatteras Island
For a state DWI charge, the first deadlines arrive before the first court date:
- Civil revocation: with a result of 0.08 or more, or a refusal, a civil revocation of at least 30 days is ordered under N.C.G.S. Section 20-16.5.
- 10 days to contest it: you can request a hearing on the civil revocation within 10 days.
- Pretrial privilege: after at least 10 days of a 30-day revocation, you may qualify for a pretrial limited driving privilege if you obtain a substance abuse assessment and meet the other requirements.
- Refusal: a separate 12-month revocation from NC DMV also applies. See refusal and license revocation.
- Conviction: a first offense brings a one-year revocation, and the judge sentences you at one of six DWI sentencing levels.
North Carolina uses the EC/IR II for evidentiary breath tests, and the results are admissible only if the testing rules were followed. Traffic Tickets on Hatteras Island
A speeding conviction in state court counts twice: DMV license points under N.C.G.S. Section 20-16, and insurance points under the Safe Driver Incentive Plan (SDIP), administered by the NC Commissioner of Insurance. Some convictions also allow DMV to suspend a license.

Court Is in Manteo, Not on the Island
Dare County court is held at the Justice Center in Manteo. From Hatteras village, that is a drive of more than an hour each way on NC 12. For many speeding tickets, your lawyer can appear for you, so you do not have to make the trip or come back from another state. A DWI depends on your case and how it is resolved, and if it goes to trial, plan to be there. We will tell you early which dates need you in person.
Visiting Hatteras Island From Out of State?
From June through September, about two in three of our clients live outside North Carolina. A North Carolina conviction can be reported to your home state, and each state applies its own law to it. Virginia DMV, for example, says on its website that it assigns demerit points for traffic convictions from other states. Where is court for a Hatteras Island ticket or DWI?
For a state charge, in Manteo, at the Dare County Justice Center, 962 Marshall Collins Drive, Manteo, NC 27954. A National Park Service citation is a federal case. See federal charges.
Is there a police department in Avon, Buxton, or Hatteras?
No. The Hatteras Island villages are unincorporated. The Dare County Sheriff’s Office and the NC State Highway Patrol enforce state law there, and National Park Service rangers patrol the National Seashore.
What about Ocracoke?
Ocracoke is in Hyde County, so state charges from Ocracoke are not heard in Manteo. Its beaches are part of Cape Hatteras National Seashore, and we handle National Park Service citations from Ocracoke in federal court. See federal charges.
